Welcome to OpenUp. By accessing or using our mobile application and related web services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account, downloading our app, or using the OpenUp platform, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must safely uninstall the app and cease using our services immediately.

2. Medical Disclaimer

OpenUp is a preventative wellness tool, NOT a medical device. It is not a substitute for professional medical advice, psychiatric diagnosis, or treatment. The meditation techniques, breathing exercises, and ambient content provided within the app are for general relaxation and informational purposes only. Do NOT use the app while driving or operating heavy machinery. Always seek the advice of your physician regarding any physical or mental health conditions.

3. User Accounts

To access personalized features of OpenUp, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials (e.g. your login information) and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use or security breach.

4. Acceptable Use

You agree to use OpenUp strictly for lawful, personal, non-commercial purposes. You must not attempt to reverse engineer, decompile, hack, or disrupt the application, its codebase, or its servers. Any abusive, harmful, or fraudulent activity will result in immediate termination of your access without notice.

5. Intellectual Property

The OpenUp application, including its source code, audio tracks, visual design elements, 3D graphics, and user interface, are and will remain the exclusive property of OpenUp and its licensors. You may not copy, reproduce, or distribute any part of the application without our express, prior written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, OpenUp and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to, use of, or inability to access or use the application.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will aim to provide reasonable notice of any material changes via in-app alerts. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the updated terms.
